Community Involvement

Community Involvement Resource Assessment of States and Territories (April 2014)
This report assesses the resources available to States for conducting community involvement activities in several State programs, including RCRA compliance, enforcement, permitting, and corrective action; Tanks; Brownfields, Land Revitalization, and Voluntary Cleanup; Federal Superfund-NPL; and Federal Facilities. States representing each of these programs provided data to ASTSWMO on their program (sites, FTE, community involvement staff), and information on the specific community involvement activities conducted in their programs. The Community Involvement Focus Group reviewed the information received from States to produce a summary and findings for each program, and provides general recommendations at the conclusion of the report.

Community Involvement Guidance for Munitions Response Sites (January 2011)
The ASTSWMO Community Involvement Focus Group developed this guidance to provide State and Federal community involvement coordinators and project managers with strategies for conducting effective community involvement activities at munitions response sites.  The guidance outlines the regulatory framework, roles, responsibilities, and special challenges faced by State regulators at these sites.  Case studies are also provided to illustrate these challenges and provide a set of lessons learned.

The results of the survey will help the group understand States' needs and also provide States the opportunity to share experience, expertise and tools for improved community involvement across the country.

Emerging Issues

Perchlorate Policy Update (April 2011)
The ASTSWMO Emerging Issues Focus Group developed this Perchlorate Policy Update to provide information on State and Federal policies, guidance, and resources specific to assessing and remediating perchlorate while performing environmental cleanups.  It is intended to serve as a source of information to assist States as they prepare to deal with the environmental assessment and cleanup at sites potentially or currently contaminated with perchlorate, and to assist States and Federal Agencies that may be considering regulatory or policy development for this contaminant of concern.   This document should serve as a supplement to the 2005 ASTSWMO Perchlorate Issues Document and other recent technical documents on perchlorate assessment and remediation.

Tungsten Issues Papers (Updated February 2011)
The ASTSWMO Policy and Technology Focus Group developed these papers to assess tungsten issues, and the inherent challenges and impacts of tungsten assessment and remediation on existing cleanup programs being implemented at federal facilities.   Version 2.0 is an update to the first version of this document, and provides updated information on remedial technologies and impacts to human health and environment.

Vapor Intrusion Pathway:  A Guide for State and Territorial Federal Facilities Managers (July 2009)
The ASTSWMO Policy & Technology Focus Group developed this guide to provide State Federal Facilities Managers with a compendium of available U.S. EPA, DoD and State regulations, policies and guidance materials relevant to the assessment of the Vapor Intrusion Pathway. The Guide also identifies challenges States may encounter during their investigations, which will be researched further by the Focus Group in the future. The guide is intended to be a living document. 

July 2010 Update:  There were no significant updates at this time.  However, USEPA’s OSWER responded to USEPA’s OIG’s evaluation report on Lack of Final Guidance on Vapor Intrusion Impedes Efforts to Address Indoor Air Risks by planning to finalize the Draft Guidance for Evaluating the Vapor Intrusion to Indoor Air Pathway from Groundwater and Soils document sometime in 2012

Incidental TENORM:  A Guidance for State Solid Waste Managers (April 2011)
The ASTSWMO Radiation Focus Group developed this guidance to inform solid waste management and other officials about technologically-enhanced, naturally-occurring, radioactive materials (TENORM) concerns and management approaches.  TENORM contamination is typically the result of process operations involving the extraction, purification, filtration, smelting, or pipeline transport of virtually any material of geological origin.  The TENORM discussed in this guidance are not federally regulated and are incidentally concentrated from various industrial processes, such as coal mining and combustion, and water treatment.  These materials have the potential to be transported to solid waste facilities or become legacy contaminants on CERCLA sites.

BRAC Guide – Chapter VII, Radiological Constituents (January 2009)
The ASTSWMO Base Closure Focus Group and Radiation Focus Group updated the October 2006 BRAC Guide to include Chapter VII, Radiological Constituents.  This chapter provides an introductory resource to State Federal Facilities Managers in evaluating the potential for radioactive contamination to be present at BRAC sites.

Green Remediation at Federal Facility Cleanups (January 2011)
The ASTSWMO Remediation and Reuse Focus Group developed this report to provide State Managers with a compendium of green remediation strategies being implemented at federal facility cleanups.  The report provides definitions, policies, guidance, and tools being used by federal agencies at federal facility cleanups, and offers recommendations to both State and Federal agencies participating in these cleanups.

Final Report: 2005 BRAC Round – State Experiences (May 2009)
The ASTSWMO Base Closure Focus Group developed this Report to document the challenges States have encountered in implementing the 2005 round of Base Realignment and Closure.  32 States assisted the Focus Group by providing State-specific information summarized in this Report.

Final BRAC Guide (Updated April 2010)
The ASTSWMO Base Closure Focus Group developed this Guide in October 2006 to identify changes to the BRAC process as outlined in DoD’s March 2006 Base Realignment and Redevelopment Manual and to assist State and Territories in working with DoD, local redevelopment authorities and communities in assuring protective, expeditious cleanup and property transfer. In January 2009, the ASTSWMO Base Closure and Radiation Focus Groups updated the Guide to include Chapter VII, Radiological Constituents.  In April 2010, the Remediation and Reuse Focus Group updated the Guide to include Appendix A, Early Property Transfer at NPL Sites.

Uniform Environmental Covenant Act (UECA) (April 2006)
This information paper for State program managers, discusses a number of matters related to the potential use of the Uniform Environmental Covenant Act (UECA). The purpose of this paper is to share with State managers a number of issues that have arisen as States consider and adopt such statutes, including the UECA model.

Analysis of Interim Risk Management at Munitions Response Sites (June 2013)
This report provides an analysis of information received by States and the Department of Defense on interim risk management (IRM) controls and elements being implemented at munitions response sites nationwide.  It provides recommendations to support the development of a national IRM framework that was proposed by the State Munitions Response Forum (MRF) in its January 2013 report.

State Perspectives on the Use of Performance-based Contracting at Federal Facilities Cleanups (August 2010)
The ASTSWMO State Federal Coordination Focus Group queried State Federal Facilities Managers to gather information on DoD’s use of performance-based contracting at federal facilities cleanups.  This report provides an analysis of the States’ responses and recommendations for improving the PBC process.  Twenty-nine States participated in analysis.

Final Report:  Effectiveness of FUDS MAPs (December 2008)
The ASTSWMO State Federal Coordination Focus Group queried the States about the effectiveness of implementing State FUDS MAPs.   This report summarizes ASTSWMO’s findings and provides State-specific information for over 40 State respondents.

The State Federal Coordination Focus Group has finalized their Removal Actions at Federal Facilities Paper. This paper explores how federal-lead agencies use their removal authority, the challenges that States deal with during federal removal activities, and provide conclusions and recommendations for the improving the States’ role in the removal action process.
