The Tanks Subcommittee includes three task forces that manage the inspection of Underground Storage Tanks (USTs) which typically contain petroleum products; provide oversight for the remediation any leaks or spills from these USTs; and administer financial assurance funds that are offered to the owners and operators of USTs.  The members also provide comments on federal policies, rulemaking and legislation and work directly with both federal officials at EPA’s Office of Underground Storage Tanks (OUST) and officials of the State and territorial UST programs.

Mission

The UST Task Force is comprised of State officials whose primary responsibility is the management and inspection of State and Federally regulated underground storage tanks to ensure that owners and operators are in compliance with the technical and financial responsibility requirements.

Past Work Products

The UST Task Force in conjunction with EPA-OUST conducted the second State – EPA Energy Policy Act Implementation Meeting on November 27-28, 2007 in Arlington, VA. 

Current Work Efforts

The UST Task Force will begin to define initial parameters of how to approach a cost analysis study for the States UST programs. This study will focus on evaluating implementation costs to respective States’ UST program for implementation of existing federal program requirements and additional costs to State programs for implementation of additional U.S. Energy Policy Act requirements. The Task Force will work with EPA-OUST to identify compatibility issues for bio-fuels. The UST Task Force will also look to identify the minimum measures to make a successful Operator Training program for the States to meet EPA’s Energy Policy Act Guidelines. The Task Force will work with EPA OUST with their recently announced effort to revise the 1988 UST regulations. During the stakeholder process, the UST Task Force/Tanks Subcommittee will discuss and identify those portions of the regulations that need revising.

LUST Task Force

Mission

The LUST Task Force is comprised of State officials whose primary responsibility is to protect human health and the environment by oversight and management of soils and groundwater remediation of leaking underground storage tank (LUST) cleanup sites.

 

Past Work Products

The LUST Task Force jointly sponsored two LUST regional technical training seminars were jointly with NEIWPCC. The training sessions took place in two separate venues: one location in the Pacific Northwest, October 22-24, 2007 in Portland, OR for the Region 10 States, and one location in the Southeast, November 14-16, 2007 in Atlanta, GA for the Region 4 States. The training sessions had a regional focus on the topics discussed.

 

Current Work Efforts

The LUST Task Force will be working on closure goals for states from EPA OUST, EDB/Lead Scavenger nation impact evaluation, Brownfield/UST field program implementation, and looking to provide EPA OUST with States guidance on the Vapor Intrusion topic.

State Funds Task Force

Mission

The State Funds Task Force is comprised of State officials who manage the 47 active State LUST Financial Assurance Funds.  During 2006, the State Funds collected $1.5 billion in annual revenues and spent a combined total of $1.01 billion on both State lead and privately managed LUST site cleanups. 

Past Work Products

The State Funds Task Force from 1996 to 2007 produced the State Fund Success Stories Compendium. The 11th Edition of the State Fund Success Stories is available at: http://www.astswmo.org/files/publications/tanks/2006-Compendium.pdf. The State Fund Task Force also has produced an Annual State Financial Assurance Fund Survey from 1996 to 2007. Current Work Effort

The Task Force is currently planning the substantive agenda for the 2008 State Fund Administrators Meeting, which will take place on June 8-11, 2008 in Charleston, SC. The Task Force will review and update the questions for its 2008 version of the annual State Financial Assurance Fund Survey and conduct the survey prior to the 2008 State Fund Administrators Meeting in June.  The results of the 2008 survey will be posted on the Tanks Publications page of the ASTSWMO web site. The State Fund Task Force will re-evaluate the name, criteria, format and frequency of the State Fund Success Stories project which was suspended in 2007. The goal of this update will be to stimulate more participation and interaction among State Fund staff.
